Please read these General Terms and Conditions ("GTC") carefully.
Between Natural Spirit.ch (meditation leader, medium, sensitive counselling and healing stone consultant, Breitenrain 8, 8917 Oerlunkhofen) and the customer, the following General Terms and Conditions apply in the version valid at the time of booking.
By accessing the website www.naturalspirit.ch, you declare that you have understood and accepted the following terms and conditions and legal information relating to the website.
If you do not agree to the following terms and conditions, please refrain from accessing all Natural Spirit.ch websites and the shop.
1.1 These General Terms and Conditions ("GTC") govern the business relationship between Natural Spirit.ch (sole proprietorship, online shop) and its customers.
1.2 The currently valid version of the GTC is available at the online shop www.naturalspirit.ch. Deviating agreements are only valid if made in writing.
2.1 The offer of products in www.naturalspirit.ch is aimed exclusively at customers with legal capacity to act who are domiciled or resident in Switzerland.
2.2 All offers in the online shop are non-binding and are deemed to be an invitation to the customer to express his interest (invitation to submit an offer at the indicated target price).
2.3 All descriptions of offers and services in flyers, newspapers, catalogues, social networks and on the Natural Spirit.ch website are not subject to any guarantee, assurance or liability.
2.4 If errors occur during the translation of aura readings, channelling and contact with the afterlife, Natural Spirit.ch accepts no guarantee and no liability. Natural Spirit.ch reserves the right to cancel a session at any time.
3.1 Insofar as the pages of this online shop contain explanations and descriptions of individual goods that refer to certain effects of the products, it is expressly pointed out that these explanations do not guarantee any effect in the scientific or medical sense.
3.2 Rather, it is about how the products on offer can be used in the traditional sense.
3.3 Stated characteristics of the goods are provided without guarantee, may be faulty and do not constitute warranted characteristics within the meaning of Art. 197 I OR. The description of the healing stones comes from the book by Michael Gienger "Heilsteine, 555 Steine von A-Z" and "Die Steinheilkunde - das Handbuch" also by Michael Gienger. I was allowed to use some descriptions from Bruno Vogler-Pfeiffer, Heilsteinschule Schweiz. A big thank you!
3.4 Any illustrations of the products are to be regarded as mere examples.
4.1 A session, all treatments, does not replace medical or medicinal treatment and does not contain any promise of a cure, but is intended to activate your own self-healing powers.
4.2 No statements about the future, diagnoses, promises of healing or therapies are made during the sessions. Health statements refer to the general state of well-being and are not to be compared with a diagnosis. Psychological or medical terms used during a session are also not associated with a diagnosis.
4.3 If errors occur in the translation of the card reading or channelling, Natural Spirit.ch assumes no guarantee and no liability.
4.4 Each customer assumes responsibility for their own actions. The decision as to which service is utilised and how the information provided is handled is made by the customer. Any liability is rejected.
4.5 For all legal bases, liability is limited to intent. Where this is not possible under the mandatory legal provisions, liability shall be limited to gross negligence.
4.6 Any liability of Natural Spirit.ch for its auxiliary persons is excluded.
4.7 Any liability for indirect or consequential damages is excluded.
As long as the customer does not object, the data from his order will be processed and used by Natural Spirit.ch to advise the customer and to optimise customer orientation. The customer can revoke this consent at any time without giving reasons. 6.1 Please note that the products offered are only suitable for the intended use and not for small children.
6.2 Natural Spirit.ch accepts no liability for improper use.
6.3 Otherwise, product liability is excluded to the extent permitted by law. No liability is accepted for slight or gross negligence in the use of the products.
6.4 As people react differently to the products, Natural Spirit.ch cannot guarantee the effectiveness or safety of the products in individual cases.
6.5 If you notice any undesirable effects, stop using the product immediately.
6.6 In the case of serious illnesses, please consult your doctor or alternative practitioner first.
7.1 After entering your personal data in the shop and clicking the "OK" button, you place an irrevocable order for the goods in the shopping basket.
7.2 You will then receive an automatic, non-binding confirmation that your order has been received and is being processed. A legally valid purchase contract is only concluded when Natural Spirit .ch sends a formal confirmation of purchase acceptance.
8.1 All prices are quoted in Swiss francs (CHF) and include VAT. The prices apply to unpacked goods and do not include shipping costs.
8.2 The prices stated at the time of the order shall apply. Price errors and price changes are reserved.
9.1 If the customer has selected the "dispatch" option during the ordering process, the ordered goods will be sent by post to the address specified by the customer in Switzerland / France.
9.2 The delivery area is limited to Switzerland and France.
9.3 Shipping costs (postage and packaging material) are charged at CHF 6.00 per order / CHF 9.00 for France.
9.4 If your order is delivered in several parts for technical reasons, shipping costs will only be charged once.
9.5 In exceptional cases, different packaging and transport costs may apply. In this case, you will be contacted by e-mail.
10.1 Orders are dispatched within 2 to 4 working days after receipt of payment, usually by A Mail. If a longer delivery time is required, the buyer will be informed by e-mail.
10.2 Specified delivery periods are for information purposes only and are not an integral part of the purchase contract. Delayed delivery does not entitle the buyer to claim damages or to withdraw from the contract.
10.3 If the buyer refuses to accept the goods, Natural Spirit.ch reserves the right to either deposit the goods in accordance with Art. 92 et seq. OR, or to withdraw from the contract. Any resulting costs (processing fees) as well as the new delivery fee shall be borne by the buyer.
10.4 If an item is not in stock, the buyer will be contacted and informed of the estimated delivery time.
10.5 If an article is no longer available, Natural Spirit.ch reserves the right not to deliver this product due to unavailability. The buyer will be informed immediately.
As an alternative to delivery, the ordered goods can be collected directly from Breitenrain 8, 8917 Oberlunkhofen. To do this, select the "Collection" option during the ordering process. With this option, no shipping costs will be charged. After receipt of payment, you will be informed by e-mail as soon as the ordered goods are ready for collection.
The risk is transferred to the buyer as soon as the goods to be delivered have left the Natural Spirit.ch warehouse or, in the case of site purchases, as soon as the buyer has been informed that the goods are available for collection.
13.1 Payment shall be made in advance (bank account transfer) or in cash when purchasing a pitch.
13.2 The amount owed (purchase price including costs) must be paid within 10 days of the order being placed. The goods will only be dispatched or made available for collection once the full payment has been credited to Natural Spirit.ch's account.
13.3 Please state your name or the name of the customer when making the transfer if this is not the same person. It can also take up to two working days for the amount to be credited to Natural Spirit.ch's account via online transfers.
13.4 No credit or instalment payments are granted.
13.5 Any surcharges resulting from the payment method shall be passed on to the customer.
13.6 If the amount owed has not been credited to Natural Spirit.ch's account after 10 working days, an invoice reminder will be sent by e-mail. If the amount is outstanding after 20 working days, a paper invoice will be sent without further request and an additional fee of CHF 10 will be charged.
13.7 Natural Spirit.ch reserves the right to initiate debt collection proceedings, to assign the unpaid payment to a debt collection agency or to withdraw from the contract.
The ordered goods remain the property of Natural Spirit.ch until payment has been received.
For hygienic reasons, no items will be taken back.
16.1 Upon receipt of the goods, the buyer must inspect them immediately and report any defects within 4 days by e-mail to info@ naturalspirit.ch.
16.2 In the event of a material defect, the buyer is entitled to free rectification, corresponding price reduction or replacement delivery. The decision in this respect depends on the nature of the defect and is made by Natural Spirit.ch at its discretion. Claims for cancellation are excluded.
16.3 Minor deviations (colour, dimensions, weight), normal wear and tear as well as defects due to improper handling are excluded from the notification of defects. Please note that the goods on offer are made from natural products and/or by hand and may therefore have small stains or imperfections. An exchange due to personal or taste reasons is excluded.
16.4 The warranty for defects of title is limited to intent and the warranty for material defects is limited to fraudulent intent.
17.1 These GTC shall be governed exclusively by Swiss law, in particular the provisions of the Swiss Code of Obligations.
17.2 The place of fulfilment and exclusive place of jurisdiction for all parties is Bremgarten AG.
Should individual provisions of these GTC prove to be invalid, this shall not affect the validity of the remaining provisions.
